Being the victim of a car crash due to texting and driving is no walk in the park. Not only you might end up being injured, but you also might lose money, working days and peace of mind. Worse, the trauma of the accident might cause you to develop phobias and PTSD (post traumatic stress disorder). Fortunately, currently a new device called the “textalyzer” is being developed to check whether the driver involved in a car crash has been using his/her phone right before the accident occurs. When available to the public, the device would make it easier for both accident victims and their personal injury lawyer to sue for compensation.
How The “Textalyzer” Would Work
Right after an accident occurs and police officers arrive at the scene, the police officer would use this “textalyzer” device to enter the driver’s phone operating system to check whether any activity (such as texting, emailing, surfing the internet) was happening right before the crash. A legal would, if approved, would also make it illegal for a driver to refuse having his/her phone inspected by the police by the “textalyzer”. Failure to comply would result in an automatic vehicle license suspension. In a way, it would work in a similar way like what happens to drivers who refuse to take the breathalyzer test to check for drunk driving.
The Dangers of Distracted Driving
Much has been said about how dangerous it is to text while driving. In a general sense, a driver should keep his/her eyes on the road all the time, but texting creates a distraction because the driver’s eyes would shift from the road to the phone screen. What happens next is usually a car crash, which is truly tragic, since this is perfectly preventable. Most text messages are usually about mundane topics that do not require immediate attention and reply, but a lot of drivers feel some kind of pressure that forces them to check their phones right after they are notified that a new text message has arrives. There is usually no disadvantage of waiting and letting the text sender wait a bit for a reply, but since humans are social creatures who put a lot of importance on smooth interpersonal relationships, a lot of drivers are putting pressure on themselves to check their phones and answer any texts right away. Add to this pressure the fact that more and more people are very attached to their phones, even to a point that could be considered as an addiction. Many people feel “lost” when they forget to bring their phones out with them, so much so that they feel like their phone is a part of their bodies. It is no wonder that drivers often do not even think about the possible dangers of fiddling around with their phones while driving. If you have been the victim of a distracted driver, contact an experienced and capable personal injury lawyer in order to get your legal compensation.
